General provisions
This document is a public offer by EV INDUSTRIES LLC (“GEARGO”, the “Seller”), taxpayer identification number (STIR) 312 786 487, legal address: 15 Bunyodkor 1st Lane, Tarnovboshi MFY, Yashnobod district, Tashkent, Republic of Uzbekistan, to any individual or legal entity (the “Buyer”) to conclude a contract for the sale of goods through the website geargo.uz (the “Site”) on the terms below (the “Agreement”).
The Agreement is made under the Civil Code of the Republic of Uzbekistan, the Law “On Protection of Consumer Rights” and the Law “On Electronic Commerce”. It is published in Uzbek, Russian and English; if the versions differ, the Uzbek version prevails.
Placing an order on the Site, or confirming an order by phone or message, is full and unconditional acceptance of this offer. From that moment the Agreement is concluded and has the force of a contract made in writing; no signature is required.
Definitions
- Goods — car parts, accessories, consumables and other products presented on the Site.
- Order — the Buyer’s request to buy Goods, placed through the Site checkout or confirmed with GEARGO by phone or message.
- Partner Seller — an independent company or entrepreneur whose Goods are listed on the Site. The product page states when Goods are sold by a Partner Seller.
- Order Confirmation — the message in which GEARGO confirms the Order’s contents, price, delivery method and expected date.
- Pickup point — GEARGO’s point at Qora Qamich 2/4, Tashkent, Republic of Uzbekistan.
Subject of the Agreement
The Seller undertakes to transfer the Goods named in the Order into the Buyer’s ownership, and the Buyer undertakes to accept and pay for them on the terms of this Agreement.
The name, description, photos, vehicle compatibility, price and availability of the Goods are given on the product page. Photos may differ slightly from the Goods in colour or packaging without affecting their characteristics or fitment.
Where the product page names a Partner Seller, the sale of those Goods is concluded with that Partner Seller. GEARGO accepts the Order and the payment, arranges delivery and handles support, returns and warranty claims, and remains the Buyer’s single point of contact.
Placing and confirming an Order
The Buyer chooses Goods, adds them to the cart and completes checkout, giving a name, phone number and delivery address. The Buyer is responsible for the accuracy of these details and for choosing Goods that fit their vehicle; on request GEARGO checks compatibility before dispatch.
After receiving an Order, GEARGO contacts the Buyer by phone or message to confirm it. GEARGO may decline or cancel an Order — for example because of a pricing or stock error, an incomplete address or an unsuccessful payment — and refunds anything already paid in full.
The Buyer may cancel an Order free of charge at any time before it is dispatched by contacting support.
Price
Prices are stated on the product page in Uzbek sum (UZS) and include VAT where it applies. Amounts shown in other currencies are for reference only; payment is made in sum in accordance with the law of the Republic of Uzbekistan.
The delivery charge, if any, is shown separately at checkout before the Order is placed.
The price of an Order is fixed by the Order Confirmation; a later change of price on the Site does not affect it. If a price is obviously wrong, GEARGO may cancel the Order and refund any payment.
Payment
The Buyer pays by one of the methods offered at checkout. Cash on delivery is available on every Order; payment by bank card (Uzcard, Humo, Visa, Mastercard) and through Payme and Click appears at checkout as each method is connected.
Card and wallet payments are processed by licensed payment providers on their own secure pages. GEARGO does not receive or store full card details.
With cash on delivery the Buyer pays in full when the Goods are handed over and receives a receipt. Refunds are made to the method used for payment.
Delivery
Delivery areas, times and charges are set out in the Delivery Terms, which form part of this Agreement. The expected delivery date is stated in the Order Confirmation.
The Buyer may instead collect the Order free of charge at the Pickup point at Qora Qamich 2/4, Tashkent, Republic of Uzbekistan once GEARGO reports that it is ready.
Handover and inspection
On handover the Buyer checks the quantity and completeness of the Goods and the condition of the packaging. Visible damage must be noted with the courier and reported to GEARGO within 48 hours with photos.
The risk of accidental loss or damage passes to the Buyer at handover. Ownership passes once the Goods are paid for in full.
Returns and refunds
Returns, exchanges and refunds follow the Refunds & Returns Policy, which forms part of this Agreement. Refunds are made within the time limits set by law, to the method used for payment.
Nothing in this Agreement restricts the Buyer’s rights under the Law of the Republic of Uzbekistan “On Protection of Consumer Rights”.
Warranty
Warranty periods and the procedure for claims are set out in the Warranty Policy and on the product page. Where the manufacturer gives its own warranty, GEARGO helps the Buyer to make the claim.
Rights and obligations of the parties
GEARGO undertakes to:
- hand over Goods that match the Order and the description on the Site, in proper packaging;
- inform the Buyer promptly of any delay or change to the Order;
- keep the Buyer’s personal data confidential and process it under the Privacy Policy;
- consider the Buyer’s requests and claims within the time limits set by law.
The Buyer undertakes to:
- give accurate contact and delivery details;
- accept and pay for the Goods on the terms of this Agreement;
- install and use the Goods in line with the manufacturer’s instructions, preferably through a qualified technician or GEARGO Master Service.
Liability
The parties are liable for failure to perform this Agreement in accordance with the law of the Republic of Uzbekistan.
GEARGO is not liable for loss caused by installing Goods in a vehicle they are not intended for, contrary to the instructions or by an unqualified person, or for delays caused by incorrect details given by the Buyer.
Force majeure
The parties are released from liability for failing to perform their obligations because of circumstances beyond their control — natural disasters, epidemics, acts of state authorities, failures of communications or transport — for as long as those circumstances last. The affected party informs the other without delay.
Personal data
By accepting this offer the Buyer consents to GEARGO processing the personal data given with the Order — name, phone number, delivery address and order details — in order to perform this Agreement, in accordance with the Law of the Republic of Uzbekistan “On Personal Data” and the Privacy Policy.
Disputes
content.publicOffer.sections.disputes.body.0
Disputes not resolved by negotiation are settled by the competent court of the Republic of Uzbekistan under its law. A consumer may also apply to the consumer-protection authorities.
Validity and changes
This offer is valid from its publication on the Site until it is withdrawn. GEARGO may change it by publishing a new version on the Site; an Order is governed by the version in force when it was placed.
